What is a Notary Public?

A Notary Public is an official of integrity appointed by state government to serve the public as an impartial witness in performing various official fraud-deterrent acts related to the signing of important documents and administer oaths. Such official acts are called notarizations or notarial acts.

What does a Notary do?

A Notary’s duty is to screen the signers for their identity, willingness to sign, and their awareness of the contents of the document or transaction. Some notarizations also require the Notary to put the signer under an oath, declaring under penalty of perjury that the information contained in a document is true and correct. Property deeds, wills and powers of attorney are examples of documents that commonly require a Notary.

When is a Notary Needed?

There are many documents that require notarizations such as mortgages, real estate deeds, affidavits and other documents often found in a loan package. These documents are not legally binding unless they’re properly notarized. No, the document itself does not become legal if it’s legally deficient prior to being notarized. Both the document issuer and signer are responsible for the content of the documents.

May a Notary give legal advice or draft legal documents?

No. A Notary is prohibited by law from preparing legal documents or providing legal counsel unless they’re also an attorney. This stands true in regards to immigration documents or being Notario Publico.

Why are Notaries Important?

Notaries help deter fraud and establish that the signer is who they claim to be, knows what document they’re signing and that they’re a willing participant in the transaction without duress or intimidation.

What are Notary Signing Agents?

Notary Signing Agents or NSA’s are all notaries, but not all notaries are NSA’s. An NSA is a certified Notary Public that is trained in assisting with loan signings most notably in mortgage, loan closing and refinancing. It is the responsibility of an NSA to help the signing correctly fill out loan packages and notarize as necessary.
